Ontario’s Special Investigations Unit closed two Greater Toronto Area files on September 4, finding in both that there were no reasonable grounds to believe an officer committed a criminal offence.
In the first, the SIU says that in the early morning of May 24 officers saw an SUV jump a cemetery pathway curb and accelerate away across cemetery grounds in the area of Albion Road and Carrier Drive in northwest Etobicoke. The driver got out and fled on foot. An officer deployed a conducted energy weapon twice, and the second discharge caused the man to fall. The 41-year-old sustained a fractured left hip socket and pelvis. The service involved was the Toronto Police Service.
SIU Director Joseph Martino concluded there were no reasonable grounds to believe an officer committed a criminal offence in connection with the man’s arrest and injuries. The file, numbered 26-TVI-233, is closed.
In the second, the SIU investigated an arrest in Markham on May 16 in which a 41-year-old man sustained a fractured left arm. Both York Regional Police and the Toronto Police Service were named. Director Martino again determined there were no reasonable grounds to believe an officer committed a criminal offence. That file, 26-OCI-218, is also closed.
A third decision released the same day concerned an arrest in Windsor and did not involve a GTA service.
The SIU is the civilian agency that investigates incidents involving police in Ontario where there has been a death, serious injury, the discharge of a firearm at a person, or an allegation of sexual assault. Its news releases are datelined Mississauga because that is where the unit is headquartered, not because incidents happened there.
